Keyser is the poet laureate of the credit world, however, taking "poetic license" with the finer points of law, although aesthetically satisfying,may be somewhat confusing to "newbies".

It is illegal as per the FDCPA for any collection activities to be done without validation, IF a validation is requested within the FIRST 30 days of an INITIAL contact by the FIRST 3rd party collection agency.AND if an account is DISPUTED.

Even then, a filed lawsuit is allowed, as long as NO OTHER collection activity takes place.

This is why, in some cases, an account will go to a collection agency and a lawsuit will be immediately filed, and the lawyer for the CA WILL NOT and CAN NOT contact or communicate wih the debtor, except in writing regarding the legal issues.

Because of technicalities, and to protect themselves from ANY possible claims, the lawyers ALWAYS attach the mini-miranda to everything that is sent out, including a filed claim in lawsuit.
