Look under the Code of Civil Procedure for "Pleadings" for the specific statute.

Make a motion to strike the affidavit on the grounds that it is fraudulent (no CA can have "personal knowledge" of an account that defaulted under the OC) and that it violates the Code of Civil Procedure because the complaint did not include a copy of the contract, nor did it explain why a copy was not available. Can't hurt.
