They can only successfully sue you where you live, in VA. Therefore, the VA statute applies as you are a resident of VA. If there were to sue you in NJ you could probably stymie them by contesting the action in the NJ courts as an "inconvenient forum". They would also not be able to establish jurisdiction over you as a VA resident. If you are a bona fide resident of VA, then you enjoy the protection of the VA laws and courts. Send the SOL letter anyway. I'm sure the CA will not be so foolish as to sue you in NJ once they are aware of the SOL in VA. Why Chat would know better and will correct me if I'm wrong, so wait for Why Chat's comments.
