You misunderstand. Yes, they must file in the correct county where you reside to make it legal. But the only way you'll get notified by EITHER county's court is through a summons. The summons will go to the last known address for you AS FAR AS THE CA IS CONCERNED. The court will "issue" the summons, but it's WRITTEN by the CA, not by the court system!

The court system will NEVER go looking for you and will NOT check to make sure that the CA files suit in the correct county. If you don't show up to court because you never got the summons, then the CA gets a default judgment. The only way the court will know that you were sued in the incorrect county is if you CONTEST the action.
