Hi, I'm so happy to have found this site! I've collected valuable information and links already today. Thank you! It's a terrific testament to this forum that I haven't once seen a poster's question dismissed with instructions to simply search the site for the answer, as that question has been answered before...as so often happens in discussion groups. I'm interested to know if anyone has had dealings with Halcomb & Wertheim, attorney's in Birmingham, Alabama, and if they can share information on what to expect out of this law firm. My Capital One account was recently assigned to them, after first being placed with a different attorney, and eight months after my last payment. Two days after replying to their initial contact letter requesting verification of the debt, I received a Statement of Account and an Affidavit signed by a Capital One employee attesting to have personal knowledge of the debt. Based on how quickly they responded with "documentation," and that it was obviously obtained prior to my requesting it, I'm assuming that they are prepared to move forward on filing suit, and that I should expect a summons fairly soon. Does anyone else read this situation in the same way? Does it sound like a scare tactic, or like serious intent? Does anyone know Capital One's track record for proving the debt in court? Any insight into how Halcomb & Wertheim and Capital One operate in these matters would be greatly appreciated. Thanks!
