There was some discussion on this, hopefully Why Chat will respond, but as far as I can recall, what Cat said is exactly right. You might need to consult an attorney in your state, and give him more info about the 401K. Maybe ask a bk attorney. You can get a free consult, and he should be able to tell you if your 401K is exempt.
