Wow! they would not take your cars. The only things they can take are whatever it was you bought at sears (depends on what it is), cash you have in the bank, and they can garnish your paycheck. Since you have started paying them, tell them how much you can pay each week, month, whatever. Over the phone they can get very aggressive and threatening if they think it will make you send them more money. YOu should read the Fair Debt Collection Practices Act - it think it is on this site under "credit problems" These are the laws the collection agency must go by in dealing with you.

They can sue you anytime, but if you start paying them a set amount and you do make the payments, they probably won't. If you stop they probably will.

If talking on the phone doesn't work, tell them to stop calling you and only communicate with you in writing. Then send them a letter stating how much you can pay and when, and start doing it immediately. Keep records of your payments. Don't give them any postdated checks, or let them draft your checking account, no matter what. Pay them with money orders, not your checks. If you already sent a check, change banks, just in case.
