Hi Tom,

The reason for not sending post dated checks is that collection agencies are famous for depositing the checks before the date you have asked them to. Banks don't care what date you put on the check, if the check is presented for payment, they process it. If the CA deposits your check early and it bounces or causes other checks to bounce, then you are liable for all the charges for that, plus, you will then have a file on Chex Systems, and will be unable to open any more bank accounts anywhere. Just make another payment as fast as you can. If $150 is too much for your budget, adjust it. The important thing is to make consistent payments. If you are making consistent, reasonable, payments, they will not sue you - and if some idiot did, a judge would not listen to it - he would throw it out. I think they will accept your next payment ;) If they ever refuse your payment, then you are in trouble and they are going to sue you.

Talking to them on the phone is what has you upset. That is what they want. If you are upset, you will give them more money and let something else go. You are not required to talk to them on the phone, you know. The law says you can tell them not to call you any more, and they have to stop. I think they have you too scared for that though, LOL. Don't skip any more months!!

Just stick to your guns, pay what you agreed to pay, and if you are doing that, you will be okay. NO checks!! No postdated checks! Not to anyone ever for any reason.

I rent a house from my brother. He asked me to give him postdated checks, because sometimes the mail is slow - he lives in another city about 110 mi from me. I said "absolutely not!" Never, ever, ever, ever.......................

Hnag in there!

Linda
