Hi Lynette,

You should be okay. The lawyers have to prove that this account is yours - to do that, they either have to have the signed purchase contract (which I doubt), or a printout of the account, showing payments made by you. They may not have any of this, they may just have a name, an old address, and the amount of money

If you go to court and tell the judge what you said in your post here, I think he would ask the lawyers to prove that this debt is not past the SOL.

I think they are counting on you not showing up at court. A debt like this, that is SO OLD, they may not really have anything much in the way of proof of anything. However, if you never showed up in court, they would still win a judgment against you and then they could come after you full force and make you pay this because you did not defend yourself by showing up in court. You are definitely doing the smart thing. Just being there to tell your side of the story is most likely going to be enough.

Keep your cool in court - don't let anything throw you. take the credit report showing "unknown" - that will be a big help. The judge will know what is going on - these judges see this stuff every day.

If something does throw you completely off, ask the judge to continue the case so you can find your paperwork, contract, bank statements, witnesses - ANYTHING YOU CAN THINK OF - just to buy some time.

I am not a lawyer, keep this in mind. I am just speaking from my own experience and what others have told me.

Best of luck - let me know what happens.

Linda
