There are a few different angles you can take. One, have you ever had contact with this collection agency? *** They have called me within the last 30 days. Except for that, there has been no contact at all. If not, they don't even have the authorization to legally collect this debt. Therefore, there is nothing they can do. Second, if you sent them a request for validation letter, they are required by law to in fact validate the debt. If they cannot, then your next move is to go thru the motions to get it off of your credit report on that basis. *** The debt was taken off of my credit report 5 months ago when I noticed that it was still listed there, and after I requested the big three credit reporting agencies to investigate the debt. They have all removed the report from my credit history. Remember, your requesting "validation" not "verification". There is a big difference. *** OK, I will include that in my letter of dispute when I send one. I have not written them a letter of dispute yet because they have not yet sent me anything in writing at all, and I am leary of the calls as anyone at all may be on the other end of the phone claiming to be a collection agency. I checked the SOL page, and The statute of limitations has expired in my state. What can Performance Capital legally attempt to do?
