IRS puts a false tax lien on a relatives house

I just found out the IRS (to whom I owe back taxes) put an incorrect tax lien on my brother's house, just because we have the same last name. My brother has since had it removed, but isn't this totally illegal??? We don't have the same Social Security number, obviously. Can they be sued for this mistake? I currently have an offer-in-compromise pending with them. I was never notified of this tax lien either.
