not too long ago i asked a few question's about my dh and his judgement.ok check this out,...we talked to the OC about the judgement. They inform us that they sent the summon to a 16 river earl, however they meant to send it to a 16 robert earl.the town is so small that the post office routed it to my dh's parents out(by the way they are in the state of mississippi and my dh was/is living in the state of texas). They claim his sister signed for the summon, however she denies signing anything.this judgement was done by default. The companies headquarters are in the state of virginia as well as the court where they wanted my dh to appear.DH made the account in the state of texas and the company had his texas address. The account manager when asked stated that they dont send out statements but rather just take out the money from a bank account.DH never set up a bank draft and always paid by cash.anyways to make a long story short,DH went to the store after applying for a job and on his bg check they had a warrent of debt on it.He went to the store and was told by account manager to make a 20.00 to stop a warrant. They still processed the judgement, which the manager didnt tell DH that that was what it was. They got a default judgement a week later and now they have made threats even though we are in dispute to garnish his wages.I know in texas we are exempt but what are ways that we could get them on for the improper service?I mean does the information had to be TOTALLY free from flaws like typos.River earl rd doesnt even exist in that town so would that be something to debate about?Sorry but can you help here :oops:Also i was on why chat's website and i came across how much interest they can tag on the judgement.Texas said with a greement it was 10% but in virginia it stated however amount the company was charging which he gave them a judgement of 21.96 % ...since the account was made in texas, isnt it illegal for them to get virginia interest?
