The SOL for both written and open contracts is 3 years in NC. You're home free.

But if they do sue you, you have to go to court and defend yourself using the SOL as your defense. They probably won't once you demonstrate that you know your rights. You can do that by sending them a cease communications letter and let them know you know.

You might want to check your credit report and see how bad it really is. Every collection agency that gets this is liable to ding your report for it if you don't dispute the debt as soon as they contact you - you have 30 days from the first time they contact you.
