Yes, they have to remove it if the company doesn't respond. Won't your mortgage broker/loan officer help you with this? Most will. There are "rapid rescoring" services now that will zap stuff off your reports for a fee - they are only available through a broker or loan officer.

Otherwise, dispute it first. If it doesn't come off there are other steps you can take, but it is a slow process.
