Having no legal or business knowledge, I can give you my thoughts on this one though, after several years in retail, if a card swipes properly and the signature is similar than there is no way the merchant could be held responsible, therefore it does come back to the card owners responsibility to report missing or lost cards, however, in cases i know of where the card has been reported but still swipes fine and the card owner loses money/credit from these transactions, banks do have insurance & should cover these costs...
