Alex,

As Linda mentioned in her response recently today, you could have continued collection activity, even though the SOL could have expired.

One course of action is, if you debt goes to a collection agency, and they contact you either by mail or phone, you can immediately request (in writing)that they cease calling and/or sending you mail regarding this debt, based on the FCRA. Once the debt is assigned back to the original creditor, legally the collection agency are no longer privilaged to look at your credit report. If you feel that there is continued efforts (once the debt goes back to the original creditor) by the collection agency. The collection agency can request an inquiry on your credit report, but a collection agency requesting an inquiry, usually has to have specific business concerning your credit worthiness.

Again, I am not saying these rule isn't abused, but the collection agency where I worked, was very strict on this.
