Telecheck and merchant fraud

What can one do when a merchant enters your check into the telecheck system more than once and did not return the voided check to me? I went to shop at this particular merchant and paid with a check. They had the new system that is supposed to debit your account and return your voided check. Well, they didn't and they have entered the check two times. I contacted my bank as soon as I saw the mistake on my bank statement and they refused payment to the merchant on the second charge. It was the same check number debitted the same day and the same amount. So they saw the errror too. But now I got a letter from telecheck that I owe the second check. Isn't this stealing by the merchant?
Now I can not write checks because of a deceitful merchant.
