Stacy,

No, you are not subject to the SOL for RI.

Jeff/Jim/whoever's information is incorrect. We have posted that repeatedly. He simply likes the answer he got from an attorney who made some assumptions. Read the definitive post from WHY CHAT here:
http://www.cardreport.com/wwwboard/messages/2761.html

This is the truth. It is not a simple answer. The answers simply are NOT simple. You must be sued in the state where you reside, or in the state where the contract was executed (by you, where you lived then), and it is usually in the state where you currently reside, because of the laws regarding "foreign judgments" and other laws bearing on the subject. There are some other "ins and outs" to it, and that is why we say you should ask an attorney. Preferably an attorney who practices in this area. The generalizations made from reading the disclosures on your credit card agreement are being misinterpreted. The post by WHY CHAT is the answer, as difficult as it sounds.

We both think that "jeff/jim/whoever" is deliberately trying to disrupt this board. Why should we take up our time with him? I asked him to point me to the original post (he refers to it in his post about "horrible advice") - he has never pointed out his original question which he claims was answered incorrectly.

We have both tried to email him, but he will not reply. The reason he will not reply is that he does not want us to know who he is. Expanded email headers will give away definitive information about his identity, which we suspect we already know.

As I advised another poster on here. Email him yourself, and if he responds, post the expanded email header here. If he does not respond, do not trust him.

If you email me, or WHY CHAT, we will respond (at some risk I might add - I have been sent viruses many times by people attempting to disable my computer or get access to my files). (It won't work, I have a firewall and update my antivirus software daily).

The reasons for the discrepancies between the various sites posting SOL information is that the laws have changed, and the webmasters have not updated the databases. A lot of them read this board - perhaps they will doublecheck and update their info. It is a pain to go research all that stuff every time someone asks. I have a full time job and a Mother who is in the hospital (I am supposed to be there with her now), and I just can't take all that time. I will give links to the state's websites where the laws are posted, but I don't have time to read and interpret the whole darn thing to find what someone is looking for. If it's that important to them, they will have to look it up themselves. In some cases, I know the answer because of some other situation I have been involved in, but I can't divulge another person's personal situation on the board.

I hope this helps. Don't let this person distract you - that's his entire purpose, I'm sure, or he would answer OUR questions. Why do you think his posts are so argumentative? He has other mostives. You have been reading my posts for a while - why would anyone say I was trying to mislead people, or that I worked for the credit industry? That's hilarious!! If you need more help with SOL's email one of us and we'll try to help. I have always answered every email, and if i don't know the answer, I am honest about it.

Forget this jerk, move on, don't respond to him. Email your questions. :)

Linda
