Your lawyer is correct.You cannot eat your cake and have it too. You may not have to wait 6 months, but each State's rules on BK are different, so I ALWAYS tell people to follow their lawyer's advice.If you file now, it will be tossed out, and you may have to wait a year or more before trying again.
