If the house had substantal equity,it IS possible the BK court could consider you mother as a "preferred" creditor in this situation,especially if there is not enough homestead exemption,but your mother should be getting legal advice from a qualified attorney who can protect her interests, not only on the subject of the house, but also any other debts that she may be left obligated for after his BK.
