You just don't give enough informatin. Bk is not something you decide on the spur of the moment and then go before a trustee and a judge for a rubberstamp. In general, if you have money left over after paying your monthly bills you won't be able to file a chapter 7. You'll end up in a chapter 13 with a payoff schedule. Also, do you own a home and if so what sort of equity do you have? That'll matter. How much are your total debts and how much of that is unsecured? See what I mean? Just not enough facts to advise. In general, if you can pay settle the lawsuit prior to trial, the lawsuit should be dismissed. As a result, at least the word judgment isn't on your credit report though R-9 paid in collections is no bed of roses. ANd yes, I wouls suspect your other creditors will see the settlement and line up for some action.
