JR, aside from the point of law that you are arguing, the fact remains that, illegal or not, these CA's WILL routinely use post-dated checks whenever they please and WITHOUT any notification of such usage to the debtor ! They can and DO clean out peoples bank accounts or take what they want without notice leaving the checking account holder with NSF fees and worse ! The banks do NOT check these things, they do everything electronically and blindly process things that, in all possibility, are NOT legal. There's NO person around to eyeball the date on a check or transaction, they get the transaction, they idiots process it !! Statutes aside, the whole point is no one should EVER give a post-dated check/transaction authorization to a CA (or anyone else for that matter) in the hopes that they will abide by the law.. CA's DON'T, and even if its anyone else you're paying, the banks don't pay attention or care !
