The creditor is correct, Equifax is reporting it incorrectly. You need to send a letter CRRR to equifax stating that you have NEVER filed BK, and demanding the information on your credit report be deleted.

If you intend to have the balance due tranferred to your name alone, you need to re-contact the creditor and ask them to do so, and to report it accurately on your credit report.

However, you should be aware that any "lates" on the account will be reported also.

You may wish to consider that if you demand that it be removed from your report as included in BK,and if the creditor has already written the whole account off, with no recourse to you for the balance, you may be opening up a can of worms.
