WHYCHAT I NEED HELP!!!

I have been posting on another forum but not getting any answers. Any input would be greatly appreciated. I have been having a battle with Midland Credit Management. An account was sold to them by FCNB. My DH was sent the 30 mini-miranda, I sent a validation request before the 30 days were up. 11 days after Midland recieved the request they started reporting to all 3 bureaus. I sent them an intent to sue. Same day they removed the tradeline from Efx. but it still on Exp. & TU. They have now, 40 days later added the 'consumer disputes per FCRA' thng to Exp. Through all of this they never validated. I also filed a complaint with BBB and their AG. We have recieved a letter from BBB that says Midland refuses to correspond w/them until DH signs a release form (have you ever heard this before?) and today we recieved a letter fm Midland saying that DH owes $xxx please make payment immediately, documentation you requested is enclosed. The thing is there was nothing else enclosed. NOTHING!!!!!!! What in the he** are they trying to pull? It is past the day I told them he was going to sue (last Fri.) But I do not want to go filing a suit without doing it right. First of all my small claims max is $2500 but I would like to sue for more b/c there is more violations. But I do not know what is after small claims? And if I went higher than small claims wouldn't their attorney be able to handle it? I have an attorney that does consumer law that is handling something for me, he said he would take a look it just b/c, but he normally does not deal with FDCPA b/c it is chump change. I am afraid to wait on him b/c I sent them the intent for last Fri. I am afraid that they are going to think we were bluffing them. I really need help on this one. Should I go ahead and file in small claims and sit back and wait to see if my attorney will handle it?
