1 - BK is complicated, lots of paperwork and legal stuff to contend with. Its ADVISABLE to have a lawyer, but you can do it pro se (w/o a lawyer) if you think you can handle all the legal work yourself. There are tons of forms and lots of things about the federal and state laws that you must deal with to have your BK go thru w/o any problems. Errors leave you open to having your case dismissed. Filing fees are $200. Many lawyers will allow you to pay in installments and when you're paid up, they file for you. 1a - Yes, the atty handles ALL problems with creditors should they arise. 2 - No. If you have included a debt to the bank in your BK, the can NOT take any money out of your account. The automatic stay prevents any and all collection efforts and that includes your bank.
