In Augustof 2002 Discover Card charged off our account.I thought it was written off as a bad debt, I didn't understand what charge off was . The balance on the statement said zero. Also in August of 2002 a law firm sent a letter to us that we were delinquent on Discover Card and that it was referred to this law firm. I asked for proof of their claim, and on October 2002 I got copies of our monthly statements and copies of our agreement terms, nothing with my signature on it. I never sent another letter for validation thinking it was canceled. A couple of weeks ago in February 2003 we got a summons/complaint from the same lawyers. It says we must appear in this case or the other side will win automatically
and we must file with the court a legal paper called an answer or motion to the court clerk. Are we to late to ask for another validation that is more to the FDCP rules. If so does it have to be on proper form and filed in the court. Or can we just send a letter to validate to the law firm and try to stop this before it goes to court? Or is to late for that? I really don't want to go to court.
