Update and need advice on 12-year old "debt"

This follows my original post on 03/20/2003. My husband received a summons out of the blue stating that he owes $3300 on a car that he purchased in FL in 1991. Due to major mechanical difficulty, he returned the car to the dealer and the contract was cancelled. He was under the impression that he owed $0.

Now, 12 years later, this comes from the finance company. We, unfortunately have NO paperwork because my husband was in the Navy at the time and his sea bag was lost upon his return to OH.

We have hired an attorney, if for nothing else, to answer the summons but he doesn't seem to give much advice; he leaves all of the decisions to us, and we are clueless.

We just found a car dealer with the same name in FL at a different address, we are contacting them today, but who knows if they will be of help, if they are even the same dealer.

I HATE the idea of paying off this attempt at collection when we feel we owe nothing, but the cost of defending our claim could run close to the same dollar amount. It is a tough call.

My questions--do you think we stand a chance at this case? And, secondly, if we would win, would there be any way we could counter sue for our costs in this mess? Anyone have any advice? Sorry this is so long.. Thanks so much, Sherry
