Amazing the number of posters from the sunsham state. Seems there might be something to the rumor that we are being used as a lab experiment by the scumbag collection 'industry'.
Here's some utterly ancecdotal, unreliable, silly non-advice for your consideration only. The Florida statutes of limitations on debt are tolled should you leave the state and take up residence elsewhere, then return. The statute is tolled should you make effort to conceal your identity and whereabouts to avoid service.
Sometimes, a sympatico lad can be found in and amongst the courthouse sheriffs, particularly when they hear that you are one of many people who are being sued by some nuisance litigant, like say f'rinstance some sewer-pickle outa town collection agency.
They have a saying, one pondered in context of that written in this message. Verse go sumt'in like dis hear: "No service? - No case."
In light of your case, based upon amount owed, this is a civil court matter, not small claims. This is possibly good. Small claims is polite doublespeak for 'Kangaroo Court", in which the debtor is guilty until garnered, shamed, defenestrated, and accused of sparking the War in the Crimea. A bad place.
At your level, upwards of 5K owed, matters are different. Competent lawyers are needed, not just the canker-sore sleazoid strain of predator who skulks about in small claims.
Real lawyers want real money, there has to be a likelihood of recovery, from what you say, this might be tough in your case.
If served, a timely answer from defendant acting as his own lawyer, pleading 'lack of knowledge' to the various counts, sometimes serves to encourage creditor lawyers to go on to the next target. Usually the other side responds to your answers in a month or two. No response is good, can sometimes become a year. After one year with no prosecution, many courts issue a bench motion dismissing case for lack of prosecution.
The collectors play a numbers game. File in volume, serve the defendant and hope he doesn't answer - the worst thing one can do. Then they get a default judgement and commence to make your life over into a living, continuous, ongoing bout of pancreatitis.
Some around here will tell you demonstrating to collectors that you are more trouble than you are worth well serves to protect you, while shoving their bloated, acetone-scented carcasses along to their next victim.
Hope this helps. Florida seems to be a free-fire zone of late, hopefully we can do our part to encourage these leeches to seek out greener pastures.
