I filed BK 3 years ago, and before I did, I pulled my credit reports to make sure I included everything. The BK was 99% medical, but I had to make sure I got everything. There was no debt on there for Ivy Tech State College. A couple of months ago, I requested a copy of my credit reports to verify the accuracy of the info being reported, and listed on my report was a debt for Ivy Tech State College of Terre Haute, Indiana. While I did attend classes there for a couple of months in 1997, I do not have a bill there (that I know of) because every single time I've attended college, my expenses are 100% paid with Pell Grants and Student Loans. I have never, ever owed a university anything. I disputed the Ivy Tech entry as "not mine" and it was never removed. Within 2 weeks of my dispute, I received a letter from Allied Collection Agency stating that I owed this debt. Here is the letter I received this weekend: "Our previous demands for payment of this obligation have been ignored. Therefore, you are hereby notified that unless settlement is made to our office, we will recommend to our client that they consider filing suit to collect this amount. Upon their approval, we may begin a suit to obtain a judgement on this outstanding balance." The amount is for $439.40, and as I said, I have no idea whatsoever what this could be for. Is the statute of limitations up on this debt? I have reviewed the statutes, but didn't really know where a school loan would fall. Can you help me? What should I do? Should I send them an SOL letter or a validation letter or what? (I'm in Indiana) Thank you very much!
