It depends on whether the CA has bought the account. My experience has been that if they have bought it then the OC is out of the picture and you will get no response from the OC.

If the OC still has the account it is hard to tell what the response will be. In one case I received a settlement offer from the CA. On the advice of my attorney I accepted with a letter to both parties but the check was made out to the OC. Now the CA is hounding me for the difference so I just refer them to the attorney.

They are trying to say the settlement wasn't valid since I did not send them the money. My suspicion is that the OC won't give them their cut. I didn't sleep at all last night worrying about them not receiving their money.

What about a two-party certified check or money order? Does anyone have thoughts on this?
