Yeah, they could sue, in Florida the threshhold for Small Shams court is one hundred dollars, not less. Again, they have made several glaring violations just begging to be noticed by the FTC, be sure to kindly contact the FTC so that this nice pile of alligator vomit doing business as a collection agency gets some much needed recognition.
Tell the FTC everything the've told you, the FDCPA is a 'thorny thicket into which a collector wades' each time he contacts a debtor. The collectors don't want you to know that. The laws are on our side and not so much against their, it's just that these goons can't help themselves.
Like criminals who get out on bail, only to hotwire a sheriff's car in the courthouse parking lot - as happened recently in Florida - these jerks do the same stupid things over and over and over again. If they lived in homes with living rooms, unless there were a sign over the mantlepiece telling them no to do so, they'd probably pee on their living room carpets and never figure out why the carpet was always wet.
They get away with their cruel idiocy because as yet not enough of us have caught on to their unlawful antics. But that is changing. You are in good shape, if they are illegally ratcheting up your bill, both the FTC and the FL Div Banking and Consumer Protection need to know this.
