Charge-off

I had a Capital One credit card that was charged off back in '01. The last activity on this account was 07/00 and the amt. owed at that time was $221 and the credit limit was $300 . Capital One waited until 07/01 to charge it off, with a charge off amt. of $1200.

I received a letter from Capital One offering to settle this account, but when I called them, the rep informed me that they couldn't settle with me, that they had turned it over to a CA by the name of Maxwell & Associates and gave me the number to call them for settlement.

I called the CA to see what kind of settlement they would offer me, which was $900. I advised them that I did not have that much money and their only other option was to pay the $900 in 2 payments. I told them that I am a single mom and that the most I could do, would be to pay them $50 month. Of course the man didn't like that answer. He threatened to have my wages garnished, to take me to court, etc.

Scared of being taken to court, I sent them 4 payments totaling $749. I told the man at the CA when I sent them money the last time that I wasn't going to be able to pay any more, because by paying them I had to let my car insurance expire and that I needed to get that coverage back before I had that big fine to pay.

Anyways, the CA called Monday and hinted around to my boyfriend that they were going to garnish my wages and that I now owed around $3000. Which I think they may try to do, because the CA called my work today requesting employment verification.

My questions are:

1. Can Capital One charge this much interest?
2. Can the CA garnish my wages? If they can, how much can they take from my check?
3. Sorry, this may be a dumb question, but someone told me that in the state of Florida, which is where I live, that if a person files "Head of Household", that your wages can not be garnished. Is this true?

Any advise would be much appreciated. Thanks!
