I do not think opting out will make any difference in your case.
That is when you get off the marketing list for the CRA's to prevent CA's from inserting old accounts when you are applying for a mortgage.

The Ca. FDCPA, which does apply to OC's MIGHT help you. It wouldn't hurt to try. Go to my website and use the SOL letter to Cap1, you will have to remove many of the references to the Feeral FDCPA and just use the CA FDCPA statutes.

However, I do not think that having a defaulted loan just a few years after BK is going to get you very far in the prime mortgage rate market.At best, the account will be changed to show a 0 balance, preventing you from having to pay it off as a condition of closing.
