Not against the law in the least. The CC company and the merchant will say this is a courtsey to avoid embarrassing you or causing inconvenince to have your card rejected.
You have the resonsibility to know your credit limit andnot exceed the limit.
You'll have a better chance if you call and ask politely for a credit limit increase and would they please waive the over the limit charge.
