Assume that they have you but keep in mind as well the fact that most legal filings are just another way of stalling for time in hope you'll admit to something.
Motion for Summary Judgement is a shorthand way of telling the court that there are no more triable issues of fact in the case, I have proven my point fully and now I want my judgement.
Many times these things are filed in hope of psyching out the other side. You know, trying to convince you that all hope is lost, you're nicked, finished, kaput. Life as you once knew it is merely a fading memory. You go to court assuming they are right yet many a time their case is not complete, they are full of it, and sometimes judges do in fact dismiss these outright. In which case you file for immediate dismissal with prejudice. Cheeky sods.
