Can you tell me if a joint checking account can be attached in Montana? The checking acct is in my husbands and my name. The attorney threatening to sue is Frederick Hanna for Sherman Acquistions. I am nowhere near the SOL, quit paying Discover in May 2002, they charged off in October 2002, sold to Sherman. In January of 2003 SA notified me, I asked for validation, never received it but I have no proof. However the letter from Hanna mentions wanting to resolve my dispute that I sent to SA so that is some proof that I sent validation request. Debt is in my name alone, however checking is with husband. Only other assets I have are a 1990 dodge shadow and a 1994 dodge van. The Van is in mine and my husbands name. Please advise if you think I should get my name off that checking acct and the van. Thanks in advance.
