Sue them for fair credit reporting violations. But I wouldn't recommend doing that because you then wake the beast. Depending on your state, you may still be within statue of limitations. Let them poison your file and when the time comes to remove it from your credit report, dispute it then. If this is the only violation, I don't recommend suing them. It is better to watch them, make notes and allow them to sink themselves. The one good news is this. Sears has signed a deal to sell off its credit card portfolio division so you will have a new owner of the account pretty soon. See what happens.
