The statue of limitations starts with the last activity before charge off. Did you make any other payments beside the last one in 8/96. You have all your statements. You prove the last payment, you have the collection letters to prove it. They have to prove the last payment. Just deny making them a payment. They have to prove it since they asserted it.

Do they have a copy of the check that you paid with?

Even if the statue of limitations was March 97, four years from that would be March 01. Six year is March 03. Go by the four year statue of limitations and do not volunteer any information.

Bring your paper work in with you and the statue of limitations. You just deny making the March 97 payment and ask them to prove it.

A computerized statement does not cut it. Do they have a check number on record? Something that they can prove. Do you keep copies of your old check registers and check booklets? If you do, have you gone back through them.

I think that someone inserted last payment in the file to make it seem that you paid and they are lying. They have to prove it.
