I am just wondering how they managed to charge off a capital one charge account for $300 when you only owed $46.30. Did you move or something and they lost your bill in the mail or did you stop paying. It is a recent bill so you are still within SOL.

However, he will probably sue in small claims court or sue becuase it is a collectable amount. Can he take your car? No. Could he garnish your husband's wages? Yes, if Oregon allows it.

They can also seize your bank account and get that. So they do have choices here but whether what he did was illegal depends on whether his company had the power to sue you or the authority to do so.

Chances are at this stage, he is yanking your chain but Capital ONe is a nasty creditor who can be sue happy on defaulted credit cards.
