California Settlement

Hi,

I recently sent a check to Providian to settle a closed account. Living in California, I wrote on the check the terms of the settlement...1 being they would update my credit report as Paid In Full.

Providian cashed the check, but sent me a letter afterwards saying they would not update my credit report as I requested.

I realized afterwards for the California Law to work, I need to first send a letter, wait 60 days, then send the check. I didn't do this first part, unfortunately.

Do you still think I have anything against Providian, since they cashed the check with the agreement written on it?
