If the attorney for the CA wants to sue you and believes you have enough assets, he will, if he doesn't or maybe he thinks you don't have any assets right now, he won't.

Did the CA threaten you in writing, in any way?

You can always try the C&D and dispute letter, and see if the CA violates the C&D, so you can leverage your way out of this. Object here is to get the CA to violate FDCPA so you can use it against them to zero out your debt. Make sure the CA has been assigned and/or purchased the debt.
