I must have mislead you in my question, let me start all over again,
My great uncle was sued and the CA, who bought his account from the OC, had garnished his wages and bank accounts. With the help of my cousin and I, we found that the CA was incorrect in taking his money and garnishing his pay. What happened was (oh and by the way, my great uncle is 66 years old) the CA had placed a default judgment on his CR. My cousin went and filed a vacate to remove the default judgment, the Court will hear the motion, soon.
Since the CA has taken all his money and we can now prove that the CA was wrong in doing this, can my uncle now sue them to get his money back.
He lives in NY, we're sure the court will dismiss the default judgment after we present the proof.
