The FCRA requires that you be notified before any report is made to your credit report.

Call this collection agency and tell them that you have never received a bill and their report the the cra is a violation of the FCRA and possibly the FDCPA.

Tell them that you have contacted your insurance and the bill was never submitted to them.

You are willing to pay what you are responsible for but not all of it simply because the hospital failed to submit the bill to Blue Cross.

Also call the hospital and tell them that they have violated the FDCPA by stating that you owe money that you are not actually responsible for. Get them to take the account back from the collection agency and advise the collection agency that it was a mistake and to remov it from your credit report.

DON'T WASTE YOUR TIME WITH ANY EMPLOYEE WHO HAPPENS TO ANSWER THE PHONE. Ask for the head of the billing department.

Be polite but firm. They will likely say that the submitted the claim to Blue Cross and it wasn't paid. At that point, ask, "Do you have docmentation that Blue Cross denied the claim?" They will probably say no, but it wasn't paid. At that point you say, "Is Blue Cross in the habit of simply IGNORING your claims - or don't they usually send a response that they are either going to pay or deny?"

They do this ALL the time. Hospitals claim that the bill was submitted to insurance but then they can't show that it was denied - they just didn't get paid! Well, if they didn't get a denial - then QUITE POSSIBLY the claim didn't get submitted!!!

Can you tell this is one of my "pet peeves"?
