I am no expert on law but I agree with your lawyer. Arbitration proceedings are governed by the rules of the governing arbitration board. The rules of procedure, the rules of evidence are different. When dealing with arbitration, it is best to have an attorney especially if you are dealing with MBNA Collection attorneys. They will twist the law. WhyChat says that arbitration can be rejected because the courts have ruled that arbitration clauses are contracts of adhesion. I don't remember the case law that he/she used but if you do a search on this sites feature under the word arbitration, you will find a bunch of posts on it.

I visit several boards and I have not come upon one person who won against collectors in an arbitration award. Maybe they are out there, they are just not posting about it.

There is no shame in going bankruptcy. If you can't pay, you can't pay. But you do need to get out of bed, see a doctor about your depression. Maybe filing bankruptcy may help you put closure in this chapter of your life so you can begin again all new with another chapter.
