You can reject the arbitration but that will not stop the NAF from issuing a arbitration judgment against your wife that W&A will use to enforce in court. You may want to send in your response rejecting the arbitration but also send interrogatories and a request for production of documents in the arbtration proceeding to see what W&A provides to establish the debt. If they don't provide sufficient evidence, then you may be able to convince the arbitrator that the debt or at least part of it is not owed. So if you dispute any part of the debt, ask for all the charge slips that make up the total amount W&A is alleging is owed by your wife. They may not be able to produce all of the actual documentation. If they do not know where you live, they can serve by publication. They should not be able to freeze your account without a court judgment. I recommend you switch banks. Get a free consultation with a bk lawyer and see if that is right for you.
