it is a bad idea not to show up. They will get a default judgement because you don't show up to defend yourself. You need to defend yourself. SOL in Delaware is 3 years. There is a very good chance that you can win this case based on the SOL. You can also ask them to validate. You are an easy target because you are embarrassed. That is what they are counting on. They will get the default judgement if you don't show up. Your house is protected in Delaware, tenents by the entirety. That works as long as you are married. It is a big mistake to let them get a judgement. Do you mean that you were served today? Once they have a judgement, they can choose to execute whenever they like. Five years from now you might have an asset, and if anything happened to your husband, your house would be in jeopardy. You probably should file individual bk. This will not effect your husband.
