The attorney is in Florida, you are in Alabama. Florida attorney can not sue you in Alabama. SOL starts with the last payment you made to MBNA before it became deliquent and was never brought up to date again. SOL in Alabama is 3 years. You are probably within months of SOL. I would IGNORE THE PHONE CALLS. Let the machine pick up and watch caller I.D. The purpose of the letter is their attempt to make you believe that they did validate. There is a lot of psychology in debt collection. CAs and their attorneys lie and threaten. They are trained to play on your emotions, to scare you into paying them. For now I would definitely IGNORE THEM. They can't scare you or threaten you if you do not talk to them. Do not acknowledge that you received the letter. IF YOU ARE SERVED WITH A SUMMONS DO NOT IGNORE IT. THAT IS THE TIME TO FIND A ATTORNEY TO REPRESENT YOU. Most will give a consultation free.
