Don't worry about ticking them off. If you inform them that the SOL has ran, and they go ahead and file anyway, you got a darn good countersuit against both the attorney and asset acceptance for willfull and malicious abuse of process.

I'd say there is a 95% chance that lawyer will tuck his tail between his legs and run after getting that letter. If he doesn't, thats a couple thousand dollars in your pocket.
