I am being sued! Sent request to OC attorney (debt collector) for validation (within SOL), they filed suit before validation. I filed answer (lacking truth and knowledge) and affirmitave defense (no validation. They sent back a reply (filed with court) to defendant's affirmative defenses, barley ledgeable signature (copy) of original application (1994) and
copy of about 8 statements from 2003 (Jan) to 2003 (Nov) stating that I never objected. This account is charged off, last payment was april 2003. Live in florida. Do I answer, or just wait, I' m not sure this is validation, and being they filed suit before proper validation, is this legal or what should i do.
Any help appreciated! PS have no money for an attorney!! Thanks alot!
