No, they can not touch his disability check, however if he has direct deposit, and they seize the bank account it would be a hastle to get the money returned. I would tell him to stop the direct deposit, because the bank will not guarantee that the account will not be seized. If the account was frozen or seized, it would be up to your dad to prove that the money is from disability. So, an ounce of prevention.....much easier. This account was never charged off? Has your dad kept it current? Is he paying the original creditor or a CA? Big difference. They absolutely can not touch his disability. He might have other assets that they can go after, or he may be judgement proof. What state are you in?
